Welcome to SmallAfrica.

SmallAfrica is a branch under Feedyblockz Australia.

 (“we”, “our”, “us”), a local online business listing platform that allows businesses to list their services and products, and allows users to find and interact with those businesses. By accessing or using our website, platform, or any associated services , you agree to be bound by these Terms of Service & User Agreement (“Terms”). Please read them carefully as they govern your use of our services.

If you do not agree with any of these terms, you should not use our Site.

We run a moral business platform rooted in respect for community norms, prioritizing ethical practices, transparency, and fostering meaningful and positive business, social connections for growth, sensitiation and developement.


1. Acceptance of Terms

By accessing or using SmallAfrica, you agree to these Terms and Conditions. If you do not agree, you must immediately discontinue using our website.

Eligibility

To use our Site, you must be at least 18 years old or have the legal authority to enter into a binding contract. By using the Site, you represent and warrant that you meet these requirements.

To list your business or access certain features on the Site, you may be required to create an account. You agree to provide accurate and complete information when registering and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

User Responsibilities

As a user of the Site, you agree to:

  • Use the Site only for business and lawful purposes and not for any illegal or unauthorized activities.
  • Provide accurate and truthful information when creating an account, listing your business, or interacting with other businesses.
  • Respect the intellectual property rights of other users, including copyrights, trademarks, and other proprietary rights.
  • Not engage in any form of harassment, abuse, or spamming through the platform.
  • Comply with all applicable laws regarding consumer protection, advertising, and business practices.
  • Is insultive, provocative, or inflammatory.

  • Promotes hate speech, violence, or any form of abuse.

  • Contains offensive language or imagery targeting individuals or groups.

  • Violates any local or international laws..

User Rights
Under the Privacy Act 1988, we give you the full right to:

  • Access and update your personal information.
  • Request that we correct or delete inaccurate or outdated data in cases where you cannot.

Business Listings:

By using our platform as a business, you agree to comply with the Australian Consumer Law (ACL), which ensures that consumers are protected from false or misleading information. Businesses listing on our platform must provide accurate, honest details about their services or products. We hold listed businesses accountable for ensuring that all claims made are truthful. Consumers are entitled to clear and accurate information, and businesses must respect their rights by offering  services that meet quality and safety standards.

If you are a business, you agree to:

  • Provide accurate and complete information about your business, including but not limited to business name, area of business , contact details, and services or products offered.
  • Ensure that your listing does not contain any false or misleading information or deceptive claims.. You are responsible for ensuring the accuracy and legality of your listing content.
  • Businesses must comply with local regulations in their area of operation.
  • Update your listing promptly 
  • Not post or promote any illegal, offensive, or harmful content, including content that violates the rights of others or contains discriminatory, racist, or harmful language.
  • Ensure that all information provided is accurate, lawful, and does not infringe on intellectual property rights.

  • Listings must not contain fraudulent, misleading, or deceptive claims.

Content Ownership and Copyright

  • Your Content: As a user or business, you retain ownership of the content you upload to the Site (e.g., business descriptions, photos, logos). However, by submitting content, you grant us a non-exclusive, rights to display, and distribute such content on the Site for the purpose of operating the platform and promoting the services.
  • Our Content: All content on the Site that is not uploaded by users (e.g., design, text, images, logos, and trademarks) is owned by us and is protected by copyright and intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our explicit permission.

We reserve the right to remove or suspend any business listing that violates these Terms or is found to be harmful or misleading to users.

 Consumer Protection and Accuracy

  • Accuracy of Information: We strive to ensure that the information provided on the Site is accurate and up to date. However, we do not guarantee the accuracy or completeness of any business listing or content provided by users or third parties. Businesses are responsible for the accuracy of their own listings.
  • No Endorsement: Listing a business on the Site does not constitute an endorsement or guarantee of its products, services, or practices. Consumers should exercise their own judgment and discretion when interacting with listed businesses.
  • User Reviews: Users may leave reviews or feedback about businesses listed on the Site. You acknowledge that these reviews are based on personal experiences and opinions, and we do not guarantee their accuracy or completeness.

Payment and Fees

If your business listing involves payment for premium features or services, you agree to pay any applicable fees as specified on the Site. All payments must be made using the payment methods supported by the Site. You agree that fees are non-refundable, unless otherwise specified in our Refund Policy.  Termination

We reserve the right to suspend or terminate your account and remove your business listing at any time, without notice, if we believe you have violated these Terms or engaged in harmful conduct. You may terminate your account at any time by contacting us or using the account cancellation feature on the Site.

Privacy and Data Protection

Your use of the Site is governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the Site, you consent to our data practices as described in the Privacy Policy. PLease do check our privacy policy Page as well for details.

Governing Law

These Terms are governed by and construed in accordance with the laws of Western Australia and Australia at large, . Any disputes arising out of or in connection with these Terms shall be resolved in the courts of [Western Australia and Australia at large.

  • Accuracy of Information

    • "Whle small Africa monitors and check on the accuracy of busnesses listed on our site, we however We do not guarantee the accuracy of these business information or content provided by third parties on this platform. Users are advised to verify details independently before making decisions."
  • Third-Party Responsibility

    • "The platform is not responsible for the products, or services of businesses listed.  engagements with listed businesses are solely at the user’s discretion and risk."
  • No Endorsement

    • "The inclusion of a business listing does not constitute an endorsement, recommendation, or approval of the business or its offerings by the platform."
  • Content Moderation

    • "While we strive to monitor content, we do not assume responsibility for user-generated content and reserve the right to remove or edit listings that violate our terms and conditions."
  • Changes and Availability

    • "The platform and its content are provided 'as-is' and 'as-available.' We reserve the right to modify or discontinue the platform at any time ." n case of dscntnuation, we make sure they are are no pendng services to render meaning, no more new requests will be taken after the dscontnuation time is period is enable. Users will be informed.


 

Advertising Code of Practice

At SmallAfrica, we are committed to maintaining a transparent, trustworthy, and ethical platform for all businesses and users. To ensure fair practices and protect the integrity of our platform, all advertisements and business listings must adhere to the following guidelines:

  1. Honesty and Accuracy
    All information provided in advertisements and listings must be truthful, accurate, and not misleading. False claims, exaggerated benefits, or deceptive content are strictly prohibited.

  2. Respectful Content
    Advertisements must respect cultural, social, and community values. Content that is offensive, discriminatory, defamatory, or promotes hate speech, violence, or illegal activities will not be accepted.

  3. Compliance with Laws
    All ads and listings must comply with local, national, and international laws, regulations, and industry standards, including consumer protection and data privacy laws.

  4. Intellectual Property Rights
    Advertisers must ensure they have the legal right to use any images, logos, trademarks, or copyrighted materials included in their listings.

  5. No Misrepresentation
    Businesses must not impersonate other companies, use deceptive branding, or falsely represent affiliations, partnerships, or accreditations.

  6. Sensitive and Restricted Content
    Content related to controversial subjects such as politics, religion, gambling, adult services, or other sensitive topics is subject to additional review and may be restricted or declined at the platform’s discretion.

  7. Right to Refuse or Remove
    SmallAfrica reserves the right to review, modify, or remove any advertisement or listing that violates this Advertising Code of Practice or is deemed unsuitable for the platform, without prior notice.

Amending or Cancelling of contents or Services

At SmallAfrica, we aim to provide flexibility for our users. Users have ful rights and contro over the contents they uplaod on our platform If you wish to amend or cancel  any listed services, you can do this anytime, In

Cancellations made after the 7-day notice period may not be eligible for a refund.  Please review your listings carefully before submission to avoid unnecessary changes or charges.

 

Copy Rights Disoute;

If you believe that any content on our platform infringes your copyright, please contact us with a detailed notice. Your request should include a description of the copyrighted work, a link to the allegedly infringing content, proof of ownership (such as registration certificates, original files, or other supporting documents), and your contact information. You may also include a statement under penalty of perjury that you have a good faith belief that the use of the material is unauthorized. Once we receive a valid request, we will review it and take appropriate action, including removal or dispute resolution. Please send your notice to support@smallafrica.com.au
